What is Litigation?

Litigation is the process of settling a legal dispute or controversy in front of a court. The litigator must be proficient in all aspects of trial law, including courtroom procedure, evidence, motions, voir dire – the questioning of potential jurors, and much more.

Generally, litigation is avoided unless all attempts at negotiation, mediation, collaboration and other efforts do not attain the desired results. Litigation is often necessary, however, when the parties cannot come to an agreement that is satisfactory to all concerned.

Alternatives to Litigation

There are numerous alternatives to litigation. These methods all have one goal in common: to reach an agreement without litigation. These include, but are not limited to the following:

  • Settling a case out of court – it is preferable to settle a case amicably, with the parties reaching an agreement. There are various methods that may be utilized to accomplish this, including:
  • Negotiation – the process of communicating with the opposing parties and reaching an agreement
  • Mediation – both parties utilize the skills of a professional, neutral third party, usually an attorney who is specially trained in mediation, to help them reach an agreement
  • Collaboration – a positive environment where the opposing parties, their attorneys, and other professionals, such as counselors work in concert in an effort to come to satisfactory terms

Family Law Litigation

If the parties can’t come to an out-of-court agreement, they may choose to litigate the case in court. A family law attorney who is an experienced trial lawyer can properly prepare, present and argue your case, whether it pertains to a dissolution of marriage, terms of the divorce, terms of child support, terms of spousal maintenance, modifications of agreements, or other issues.
